Terms of Service

Welcome to fluxx.work ("Service", "we", "us"). By creating an account or using the Service in any way, you agree to these Terms of Service ("Terms"). If you do not agree, you must not use the Service.

1. The Service

Fluxx is an AI-powered product and fashion image generation platform. You upload reference images and Fluxx uses third-party AI models (currently Google Gemini) to generate studio-quality product photos. All output is produced by AI and is provided on an "as is" and "as available" basis.

2. AI-generated output — disclaimer and inherent limitations

• AI image generation is an inherently probabilistic process. Output quality, accuracy, and consistency cannot be guaranteed for any individual request.
• Generated images may contain artefacts, distortions, unexpected alterations to product details, colour variations, or other imperfections. These are known limitations of current AI technology, not defects in the Service.
• Fluxx makes no warranty that generated images will be marketplace- compliant (e.g. Amazon, Flipkart, Meesho) or meet any platform's specific requirements. You are solely responsible for reviewing every image before commercial use.
• Fluxx is not liable for any business loss, listing rejection, account suspension, or other consequences arising from the use of AI-generated images on any third-party platform.

3. Credits, billing, and refund policy

• The Service operates on a prepaid credit system. You purchase credits in advance; generating images deducts credits from your balance.
• Credits are non-refundable. All purchases are final. Once credits are purchased, no refunds will be issued under any circumstances, including but not limited to: dissatisfaction with AI-generated output, generation failures caused by third-party AI service outages or limitations, change of mind, or account closure.
• Where a technical failure causes zero images to be returned (i.e. the generation produces no output at all), the credits for that specific failed run may be automatically refunded to your credit balance as a goodwill gesture at Fluxx's sole discretion. This does not apply to cases where images were produced but the quality did not meet your expectations.
• Credits have no monetary value, cannot be transferred between accounts, and cannot be exchanged for cash.
• Prices are displayed exclusive of applicable taxes including GST. You are responsible for any taxes applicable to your purchase.

4. Your content and your responsibilities

• You represent and warrant that you own or hold all necessary rights, licences, and permissions over every image, brand, logo, trademark, design, and likeness you upload to the Service.
• You are solely responsible for ensuring your uploads and generated images do not infringe any third party's intellectual property, privacy, or publicity rights.
• You retain ownership of your uploaded content. By uploading, you grant Fluxx a limited, non-exclusive licence to process your content solely to provide the Service.
• You must not upload images of real individuals without their explicit consent, generate deceptive or fraudulent content, or use the Service to create content that violates applicable law.

5. Limitation of liability

To the fullest extent permitted by applicable law:

• Fluxx and its operators, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or exemplary damages, including loss of profits, revenue, data, goodwill, business opportunity, or other intangible losses, arising out of or in connection with your use of the Service or any AI-generated output.
• Fluxx's total aggregate liability for any claim arising out of or relating to these Terms or the Service is limited to the total amount of credits purchased by you in the three (3) calendar months preceding the event giving rise to the claim.
• Fluxx is not responsible for the outputs, errors, or limitations of any third-party AI provider, including but not limited to Google Gemini. Service outages, rate limits, or quality degradation from third-party providers do not entitle you to refunds or compensation.

6. Indemnification

You agree to indemnify, defend, and hold harmless Fluxx and its operators from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of: (a) your uploaded content; (b) your use of generated images; (c) your violation of these Terms; or (d) your violation of any third party's rights.

7. Acceptable use

• You must not attempt to circumvent credit limits or billing.
• You must not use the Service to generate illegal, harmful, abusive, or deceptive content.
• You must not reverse-engineer, scrape, or attempt to extract Fluxx's AI models or infrastructure.
• We reserve the right to suspend or permanently terminate any account that violates these Terms, with no obligation to refund unused credits.

8. Data and privacy

We collect and process only the data necessary to operate the Service — your email address, hashed password, and credit balance. We do not permanently retain your uploaded or generated images. See our Privacy Policy for full details.

9. Changes to the Service and these Terms

We may modify the Service, credit pricing, or these Terms at any time. Continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.

10. Governing law and disputes

These Terms are governed by the laws of India. Any disputes arising from or related to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts located in the operator's registered city.

Fluxx.work is operated by Puneet Dugar. This business is not registered under GST; PAN CCMPD4031J is provided in lieu of GSTIN where a tax identifier is required.
