Terms of Service

Welcome to fluxx.work ("Service", "we", "us"). By creating an account or using the Service in any way, you agree to these Terms of Service ("Terms"). If you do not agree, you must not use the Service.

1. The Service

Fluxx is an AI-powered product and fashion image generation platform. You upload reference images and Fluxx uses third-party AI models (currently Google Gemini) to generate studio-quality product photos. All output is produced by AI and is provided on an "as is" and "as available" basis.

2. AI-generated output — disclaimer and inherent limitations

• AI image generation is an inherently probabilistic process. Output quality, accuracy, and consistency cannot be guaranteed for any individual request.
• Generated images may contain artefacts, distortions, unexpected alterations to product details, colour variations, or other imperfections. These are known limitations of current AI technology, not defects in the Service.
• Fluxx makes no warranty that generated images will be marketplace- compliant (e.g. Amazon, Flipkart, Meesho) or meet any platform's specific requirements. You are solely responsible for reviewing every image before commercial use.
• Fluxx is not liable for any business loss, listing rejection, account suspension, or other consequences arising from the use of AI-generated images on any third-party platform.

3. Credits, billing, and refund policy

• The Service operates on a prepaid credit system. You purchase credits in advance; generating images deducts credits from your balance.
• Monthly plans (Growth, Pro and Business) are subscriptions that renew automatically each month by charging your saved payment method until you cancel. You can cancel at any time from Settings; cancellation stops future charges. Cancelling does not by itself refund a payment already made; the credits from every payment stay in your balance and, while unused, can be refunded as described below.
• Refunds are for unused paid credits only, and only while they have not expired. You may claim a 100% refund of credits you paid for, have not used and that have not expired, by writing to us from your account email. We refund the price you paid for those credits to your original payment method and remove them from your balance. Full terms are in our Refund Policy.
• Used credits are non-refundable, in any circumstances, including dissatisfaction with AI-generated output, outages or limitations of third-party AI services, change of mind, or account closure.
• Free and bonus credits are non-refundable and are never exchanged for money. This includes signup credits and any promotional, referral, loyalty or reward credits, and any extra credits granted on top of what you paid for. Where a balance holds both, free and bonus credits are treated as used first.
• Where a technical failure means an image is not delivered, the credits for that image are automatically returned to your balance. This does not apply where images were produced but did not meet your expectations.
• Apart from the refund of unused paid credits above, credits have no monetary value, cannot be transferred between accounts, and cannot be exchanged for cash.
• Prices shown in Indian Rupees on the pricing pages include GST at 18%, and checkout itemises the GST within that total. Orders billed to a buyer outside India are a supply exported from India and are zero-rated for GST, so no GST is charged on them. You are responsible for any taxes applicable to your purchase in your own jurisdiction.

4. Your content and your responsibilities

• You represent and warrant that you own or hold all necessary rights, licences, and permissions over every image, brand, logo, trademark, design, and likeness you upload to the Service.
• You are solely responsible for ensuring your uploads and generated images do not infringe any third party's intellectual property, privacy, or publicity rights.
• You retain ownership of your uploaded content. By uploading, you grant Fluxx a limited, non-exclusive licence to process your content solely to provide the Service.
• You must not upload images of real individuals without their explicit consent, generate deceptive or fraudulent content, or use the Service to create content that violates applicable law.

5. Limitation of liability

To the fullest extent permitted by applicable law:

• Fluxx and its operators, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or exemplary damages, including loss of profits, revenue, data, goodwill, business opportunity, or other intangible losses, arising out of or in connection with your use of the Service or any AI-generated output.
• Fluxx's total aggregate liability for any claim arising out of or relating to these Terms or the Service is limited to the total amount of credits purchased by you in the three (3) calendar months preceding the event giving rise to the claim.
• Fluxx is not responsible for the outputs, errors, or limitations of any third-party AI provider, including but not limited to Google Gemini. Service outages, rate limits, or quality degradation from third-party providers do not entitle you to refunds or compensation.

6. Indemnification

You agree to indemnify, defend, and hold harmless Fluxx and its operators from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of: (a) your uploaded content; (b) your use of generated images; (c) your violation of these Terms; or (d) your violation of any third party's rights.

7. Acceptable use

• You must not attempt to circumvent credit limits or billing.
• You must not use the Service to generate illegal, harmful, abusive, or deceptive content.
• You must not reverse-engineer, scrape, or attempt to extract Fluxx's AI models or infrastructure.
• We reserve the right to suspend or permanently terminate any account that violates these Terms, with no obligation to refund unused credits, paid or free.

8. Data and privacy

We collect and process only the data necessary to operate the Service — your email address, hashed password, and credit balance. We do not permanently retain your uploaded or generated images. See our Privacy Policy for full details.

9. Changes to the Service and these Terms

We may modify the Service, credit pricing, or these Terms at any time. Continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.

10. Governing law and disputes

These Terms are governed by the laws of India. Any disputes arising from or related to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts located in the operator's registered city.
